After a long research, in different web pages, relating to what are prenups, now I can create my own definition about this term. Therefore, Prenuptial Agreements is an agreement between the couple, before the marriage, where they specifies what each person's property rights will be in case of divorce. Such agreements already existed long ago, where only economic interests were agreed in case of divorce. But, definitely, the fashions always come back and this can not only be seen in fashion, but also in these types of agreements, which are becoming fashionable. As in everything, this new agreement has good things and other things that aren't so good, its pros and cons.
On one hand, this premarital agreement has some pros. Above all, this can be useful for rich or famous people because if you have, for example, your own business or a lot of money, it can't be divided and can't be subject to the control or involvement of your former spouse upon divorce.
Besides, apart from economic interests, it can also be beneficial for children, because this agreement can protect the inheritance rights of children from previous marriages and it can also determine custody of the child, always in case of separation.
It should be noted that if one spouse has more debt than the other, with the agreement it can protect the debt-free spouse, so he or she haven't to assume the obligations of the other. In general, you can agree to the distribution of decisions and responsibilities.
On the other hand, this agreement also have some cons. Most disadvantages are financial. For example, if you help your partner in his business, you may not be entitled to claim a share of money. This agreement also implies to give up your right to inherit from your spouse's estate when he or she dies.
A part from this economic issues, it also has another disadvantages, for example, if you start a relationship with a contract that sets forth the particulars of what will happen upon death or divorce can engender a sense of lack of trust.
From my point of view, I totally disagree with this type of agreements. I think that the last one disadvantage that I written invalidates all the advantages that I have exposed. The most beautiful thing about a relationship is trust. Therefore, starting with a contract gives an impression of lack of confidence and, most importantly, lack of love and affection. That is why I don't understand that before getting married, which according to what people says is one of the most beautiful things in life, you think of an agreement like that.
